Terms of Use: Kids Club Service

TERMS OF USE OF THE KIDS CLUB SERVICE OF MIRAMAR SHOPPING CENTER

These Terms are intended to regulate the conditions of use of the Kids Club service at Miramar Shopping Center, so that children can enjoy a wide variety of fun and entertaining games in a safe and protected environment.

TERMS OF USE OF THE SERVICE

  • Children aged between 4 and 12 years old may use the Kids Club playroom service.
  • Each child may stay in the playroom for a maximum of one and a half hours. Late pickup will entitle the Shopping Center Management to restrict access to the Kids Club for one month (in case of two violations) or two months (in case of three violations), and may even lead to expulsion from the Kids Club in the case of repeated non-compliance.
  • The playroom service is open from Wednesday to Friday from 5:00 PM to 8:00 PM. On Saturdays and public opening holidays, from 12:00 PM to 2:00 PM and from 5:00 PM to 9:00 PM.
  • Only the father, mother, or legal guardian of the child, as well as any legally competent adult responsible for the child at that time (hereinafter the “Responsible Party”), may leave the child at the playroom.
  • The Responsible Party leaving the child at the Kids Club must sign an authorization including a valid and operational phone number for contact at any time.
  • Children may not leave the Kids Club unless picked up by the same person registered as Responsible in the entry record. Otherwise, the Responsible Party must expressly authorize the person collecting the child. Presentation of an ID or equivalent document will be mandatory to verify the identity of the authorized person.
  • Kids Club monitors are not allowed to accompany children to the restroom in order not to neglect the supervision of the rest of the children.
  • Initially, entry will be limited to a maximum of 25 children, and depending on the characteristics of the children, this number may be increased at the discretion of the monitors until maximum capacity is reached.
  • If capacity is full, children must wait for their turn, which must be requested from the monitors.
  • Food, drinks, sharp or pointed objects, or any other items that may affect safety, hygiene, or the normal operation of the Kids Club are not allowed. Only plastic water bottles brought by each child are permitted.
  • The Shopping Center is not responsible for any consequences arising from illnesses or allergies that children may have. In any case, the Responsible Party must inform the staff of such conditions.
  • The Kids Club is not responsible for lost personal belongings.
  • Toys not belonging to the Kids Club are not allowed.
  • To access the premises and become a Kids Club member, it is mandatory to download and install the official Miramar Shopping Center app, which must be shown at the entrance.
  • To become a member and enjoy the activities, acceptance of these Terms of Use is required.

    Miramar Shopping Center Management reserves the right to temporarily or permanently restrict access to the service for those Responsible Parties or children who repeatedly fail to comply with the established rules, prevent the proper functioning of the playroom, or compromise the safety and well-being of the children and Kids Club staff.

    Miramar Shopping Center Management reserves the right to modify the terms of this free service.

PRIVACY POLICY

THE COMMUNITY OF PROPERTY OWNERS PARQUE MIRAMAR DE FUENGIROLA is aware of the importance of guaranteeing the right to privacy and data protection of users and, in this regard, in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), as well as Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights (LOPDGDD), the following aspects regarding the processing of personal data through this website are hereby informed.

Purpose of processing

  • Kids Club services: The information provided will be processed solely for managing the playroom service, as well as services related to membership in the Club (sending information about activities and events, greetings on special dates, or any other relevant information for families related to the Kids Club service).
  • Commercial communications: Where explicit consent has been given during registration, your data will be used to send personalized commercial information via electronic means about activities, offers, and promotions of Miramar Shopping Center. This involves prior analysis of your user profile to determine preferences and the products and services most aligned with your browsing habits.

Accuracy of information provided

Mandatory fields in the registration form are required for proper service provision; otherwise, access to the Kids Club cannot be granted.

All information provided must be accurate and truthful. The Responsible Party guarantees the authenticity of the data provided and is solely responsible for any false or inaccurate statements and for any damages caused to MIRAMAR SHOPPING CENTER or third parties.

Legal basis for processing

  • Kids Club services: The legal basis is the execution of the pre-contractual relationship between the parties, in accordance with Article 6.1(b) of the GDPR.
  • Commercial communications: The legal basis is the explicit consent of the data subject, who may withdraw it at any time without affecting the lawfulness of processing prior to withdrawal.

Recipients of information

We inform users that the processing of information collected through this website does not involve international data transfers. No data will be shared with third parties unless legally required. Only our service provider responsible for managing the playroom service may access the data, under a signed data processing agreement.

Retention period

  • Kids Club services: Data will be retained for as long as necessary to manage the service and membership. Afterwards, data will be blocked for the legal limitation period and then deleted.
  • Commercial communications: Data will be kept indefinitely unless the user unsubscribes, in which case it will be deleted and added to our Robinson List to prevent further commercial mailings.

Exercise of rights

The data subject has the right to access, rectify, erase, and restrict processing of their personal data, as well as to object to processing under certain circumstances. They also have the right to data portability. Requests may be sent to rgpd@ccmiramar.com or to Avenida de la Encarnación s/n, CP 29640, Fuengirola, Málaga (Spain).

If the data subject believes their rights have been violated, they may lodge a complaint with the Spanish Data Protection Authority (www.aepd.es).

INFORMATION SECURITY

MIRAMAR SHOPPING CENTER uses appropriate technologies to protect personal data. However, no technology is completely invulnerable, so users should also take appropriate measures to ensure the security of their data.

The center has implemented technical and organizational measures to ensure data security and prevent unauthorized access, alteration, loss, or processing.

JURISDICTION AND APPLICABLE LAW

These Terms and Conditions are governed by Spanish law. In case of dispute, the parties submit to the courts of the user’s domicile when acting as a consumer.

MODIFICATION OF THESE TERMS

MIRAMAR SHOPPING CENTER reserves the right to modify these Terms to adapt to legal or jurisprudential changes or industry practices. Changes will be announced in advance.
